No action requested on Iranian Ebrahim Hamidi, sentenced to death for homosexuality

Ebrahim Hamidi, eighteen year old Iranian who faced the death sentence for alleged sexual assault against a man took place two years before, when she was only 16.

Ebrahim Hamidi was involved in a brawl on the outskirts of Tabriz in East Azerbaijan province. Subsequently he and three friends were arrested, accused of having committed sexual assault on one of the men with whom they had fought. Hamidi has confessed to the crime after three days of detention, during which he told of being tortured. The other three defendants were promised that they would be freed if they testified against Ebrahim Hamidi. All four were originally sentenced to death, but during a third trial, three other defendants were acquitted while Ebrahim Hamidi was again sentenced to death for lavat, or "sodomy."

On July 7, 2010, the alleged victim admitted in a statement recorded by police, his parents had been lobbying to move false accusations. The Supreme Court has rejected the ruling of the Court of East Azerbaijan province and ordered a review of the case.

Ebrahim Hamidi is represented by a leading human rights lawyer Mohammad Mostafaei, who was forced to leave the country following several threats faced by him and his family early in 2010, probably because of his work in for Sakineh Mohammadi Ashtiani sentenced to death by stoning on charges of adultery.

 Mohammad Mostafaei had written an open letter on the case of Ebrahim Hamidi in July 2010 with the intent to increase the focus on execution of death sentences for juvenile offenders in Iran. The same lawyer had then informed that in case of need there was Ebrahim support operations since the Supreme Court had specifically rejected the death sentence and ordered a review of the case.

Ebrahim's case has returned to public attention in late August, following the letter writers Philippe Besson, Gilles Leroy on the daily Le Monde, without any news about the development of the award.

Monday, September 6, 2010, as reported Idaho Comets (International Day Against Homophobia), the French Foreign Minister Bernard Kouchner and the French Ambassador for Human Rights met with the lawyer Francois Zimeray Mostafaei in exile in Oslo. The meeting had as its principal object the event of Sakineh Mohammadi Ashtiani. The lawyer has however confirmed that in the case of Ebrahim there is no need and does not recommend any public action, as precendentemte said.

Furthermore, the association had followed Ebrahim from the first sentence, IRQO (Iranian Queer Organization), stated that the case will be filed soon for lack of evidence and every international attention, especially if connected to LGBT movement, and the authorities could tighten return to aggravate the situation.
The French Foreign Ministry, after meeting with his lawyer Mostafaei, therefore decided that no further action on the case of bilateral Ebrahim.

Ebrahim Hamidi, diciottenne iraniano che rischiava la condanna a morte per presunta aggressione sessuale ai danni di un uomo avvenuta due anni prima, quando ne aveva solo 16.

L’avvocato del ragazzo conferma che non c’è necessità di una azione pubblica e IRQO (Iranian Queer Organization) ci fa sapere che il caso sarà presto archiviato.

Ebrahim Hamidi è stato coinvolto in una rissa nella periferia di Tabriz, nella provincia dell'Azerbaijan orientale. In seguito lui e tre suoi amici sono stati arrestati, con l'accusa di aver commesso violenza sessuale su uno degli uomini con cui avevano lottato. Hamidi ha confessato il delitto dopo tre giorni di detenzione, durante il quale ha raccontato di essere stato torturato. Agli altri tre imputati è stato promesso che sarebbero stati liberati se avessero testimoniato contro Ebrahim Hamidi. Tutti e quattro sono stati inizialmente condannati a morte, ma nel corso di un terzo processo, gli altri tre imputati sono stati assolti mentre Ebrahim Hamidi è stato nuovamente condannato a morte per lavat, ovvero "sodomia".

Il 7 luglio 2010, la presunta vittima ha ammesso, in una dichiarazione registrata dalla polizia, che i suoi genitori gli avevano fatto pressione per muovere accuse false. La Corte Suprema ha quindi respinto la sentenza della Corte provinciale dell'Azerbaijan orientale e ha ordinato un riesame del caso.

Ebrahim Hamidi è rappresentato da un importante avvocato per i diritti umani Mohammad Mostafaei, che è stato costretto a lasciare il paese a seguito delle numerose minacce subite da lui e dalla sua famiglia all'inizio dell'agosto 2010, probabilmente a causa del suo lavoro in favore di Sakineh Mohammadi Ashtiani condannata alla lapidazione con l'accusa di adulterio.

Mohammad Mostafaei aveva scritto una lettera aperta sul caso di Ebrahim Hamidi nel luglio 2010 con l'intento di far crescere l'attenzione sull'esecuzione delle condanne a morte di imputati minorenni in Iran. Lo stesso avvocato aveva poi fatto sapere che nel caso specifico di Ebrahim non c’era bisogno di azioni di sostegno in quanto la Corte Suprema aveva appunto respinto la condanna a morte, ordinando il riesame del caso.

Il caso di Ebrahim è tornato all’attenzione pubblica a fine agosto, a seguito della lettera degli scrittori Philippe Besson e Gilles Leroy sul quotidiano Le Monde, senza però nessuna novità riguardo allo sviluppo della sentenza.

Lunedì 6 settembre 2010, come riportato dall’IDAHO Cometee (International Day Against Homophobia), il Ministro degli Esteri francese Bernard Kouchner e l'Ambasciatore francese per i diritti umani François Zimeray hanno incontrato l'avvocato Mostafaei in esilio ad Oslo. L'incontro ha avuto come oggetto principale il caso di Sakineh Mohammadi Ashtiani. L'avvocato ha però confermato che nel caso di Ebrahim non c'è necessità e non si consiglia nessuna azione pubblica, come già precendentemte affermato.

Inoltre, l’associazione che aveva seguito Ebrahim fin dalla prima condanna, IRQO (Iranian Queer Organization), ha precisato che il caso verrà presto archiviato per insufficienza di prove e ogni eco internazionale, specialmente se collegato al movimento LGBT, potrebbe irrigidire le autorità e tornare ad aggravare la situazione.

Il Ministero degli Esteri francese, dopo l’incontro con l’avvocato Mostafaei, ha quindi deciso di non procedere ad ulteriori azioni bilaterali sul caso di Ebrahim.

Arcigay, in costante contatto con le altre associazioni LGBT europee, sta seguendo attentamente la vicenda ed è in diretto contatto con IRQO (Iranian Queer Organization) che, insieme all’avvocato Mostafaei, segue il caso di Ebrahim.
